Sam Destito and Julie Tattoni Represent Prominent Insurance Company in Its Successful Application to Sell Car Insurance in New Jersey

Sam Destito and Julie Tattoni represented Nationwide Mutual Insurance Company before the New Jersey Department of Banking and Insurance to obtain approval of Nationwide's rating system and policy forms to begin selling private passenger automobile insurance in New Jersey. The Insurance Practice Group has a long history advising on automobile coverage matters, including:

  • Serving as counsel to various insurance clients, appearing before the New Jersey Supreme Court on a number of issues, including the constitutionality of the FAIR Act and the interpretation of the Flex Law, Excess Profits Law, Verbal Threshold Law, Deemer Statute for out-of-state motorists, and the Public Advocate fee statute;
  • Representing the New Jersey auto insurance industry, defeating medical provider challenges to Automobile Insurance Cost Reduction Act (AICRA) regulations and the new expanded Personal Injury Protection (PIP) medical fee schedule promulgated by the New Jersey Commissioner of Insurance; and
  • Serving as counsel to the New Jersey auto insurance industry in its appeal of the Department's adoption of the Territorial Rating Equalization Exchange (TREE), a program that was ultimately abandoned.
