Case Win - Bruce Bronster, Don Abraham Successfully Defend Prominent Meat Purveyors in Real Estate Dispute

Bruce Bronster, Partner, and Don Abraham, Special Counsel, successfully defended the owners of LaFrieda Meat Purveyors from a broker’s commission lawsuit filed in the Commercial Division of the Supreme Court of the State of New York, New York County. 

The broker sought to recover a commission for a property sold by the LaFriedas in the West Village for $31 million.  The broker alleged that she was a procuring cause of the sale even though she had no evidence demonstrating any connection between the LaFriedas and the buyer beyond her alleged mere introduction of the property to the buyer several years before the transaction took place. 

The Hon. Justice O. Peter Sherwood granted summary judgment dismissing the broker’s breach of contract claim finding that there was no evidence to support her claim that she was a procuring cause of the sale. Accordingly, the broker was not legally entitled to any commission. Justice Sherwood also dismissed the broker’s related claims of unjust enrichment, quantum meruit, fraud, and equitable estoppel.
