Authored - NJ Contract Law Update - Important Case On Accord And Satisfaction
MARCH 21, 2014 | Windels Marx - Commercial Litigation

Ameritemps, Inc. v. Hainesport Industrial Railroad, LLC, ___ N.J.Super. __, 2014 WL 684583 (N.J.App.Div. Jan. 27, 2014), may be the new 'go-to' case on accord and satisfaction. It cites the few leading cases, many of which were at the trial level. Now the law is 'all' at an appellate level.

If a claim you are handling seems to have been resolved (or it is so alleged), and compromise/settlement principles are not easily adapted, the best option may be to consult Ameritemps on accord and satisfaction.
