Case Win - Rob Wilk Defends Investor's Title to Foreclosed Property

Rob Wilk (Associate, New York) successfully defended a real estate investor's title to property purchased following a New York City foreclosure sale. The former owner of the property, whose interest was foreclosed, sought to vacate the deeds and set aside the sale on numerous grounds.

Rob demonstrated to the court that the investor's title should not be set aside, because the sale price was adequate, publication of the sale notice was proper, no allegations cast suspicion on fairness of the sale, the former owner failed to take any action to protect its interest in the property before the sale and the investor would be prejudiced.

The judge, largely adopting Rob's arguments, found that the judicial sale should be upheld.
