Case Development - Rob Wilk Wins Contested Motion for Possession of, and Interim Access to, Long Island Commercial Property

Rob Wilk (associate, New York), representing a national commercial real estate investment company, prevailed in a motion heard by the New York Supreme Court for the eviction of the occupants from commercial property on Long Island. The motion was opposed by the former property owner and occupant who was represented by counsel.

In connection with this Order to Show Cause, Rob also obtained "same-day" emergency relief granting our client immediate access to enter the occupied premises to inspect and repair any dangerous conditions. This relief, considered to be critical by our client, was effective through the motion's hearing date. At the hearing, which was also contested by the occupant's attorney, Rob argued for, and obtained, additional unusual and extensive provisional relief from the court. This restrained the occupant from interfering with, and allowed any needed inspections and repairs by our client to continue, through the determination of the motion.
