Case Development - Bruce Bronster, Michael Resnikoff and Josef Abt Successfully Counsel NYCTL 2009-A Trust in Real Property Tax Lien Foreclosure Action

Bruce Bronster (Partner, New York), Michael Resnikoff (Special Counsel, New York) and Josef Abt (Associate, New York) successfully represented Plaintiff NYCTL 2009-A Trust in an action to foreclose on a real property tax lien. Defendants were appealing a 2011 Kings County Supreme Court order granting the plaintiff summary judgment and denying the defendants' motion to dismiss the complaint, but the Supreme Court's Appellate Division, Second Department affirmed the order. The court ruled that the plaintiffs "demonstrated their prima facie entitlement to judgment as a matter of law by submitting proof that the appellants had made no payments on the subject tax lien."

The foreclosure was a result of the defendants' failure to pay "certain sewer rents, sewer surcharges, and water rents".
