I. Leo Motiuk
In the environmental area I. Leo Motiuk focuses on transactional, regulatory and litigation matters. He has been Special Litigation Counsel in a number of major matters, including a successful challenge to a water discharge fee permit system devised by the State of New Jersey and a successful defense all the way to the United States Supreme Court against the City of Philadelphia and others in regard to solid waste flow orders. He has served as a Special Hearing Officer in a multi-year litigation involving one of the major landfills in New Jersey and has been actively involved with many multi-party Superfund matters, including participation with allocation and steering committee issues.
Mr. Motiuk had a lead role in the initial development of the Memorandum of Agreement program where the New Jersey DEP first allowed innocent developers to conduct investigations at contaminated sites without having to commit to the broader obligations of an Administrative Consent Order. Mr. Motiuk was also involved with the preparation of the first amendments to the New Jersey's Spill Act (mini Superfund law), which set forth qualifications and protections for innocent purchasers. At the invitation of the Netherlands Government, Mr. Motiuk made a presentation at The Hague in regard to public policy alternatives for the reclamation of contaminated properties. He recently participated in the U.S. State Department funded Citizen Development Corps program as a counselor to a major law firm in Odessa, Ukraine.
Mr. Motiuk has directed due diligence programs for lenders, as well as sellers and buyers. He has also assisted in carrying out compliance auditing and crisis management programs that have maximized the use of client resources and prevented or mitigated government enforcement actions.
In the employment area, Mr. Motiuk has acted as Special Litigation Counsel for the New Jersey Business and Industry Association in a successful challenge to certain mandatory health coverage provisions of the original New Jersey Family Leave Act. He has also served as a special hearing officer for New Jersey Division on Civil Rights cases and as an arbitrator of disputes in both New Jersey and New York between the state governments and various public sector unions. He has been an Adjunct Professor at the Rutgers Institute for Labor-Management Relations.
Mr. Motiuk is a former chair of Environmental Committees of both the American and New Jersey Bar Associations and has served in New Jersey State Government as an assistant counsel to the Governor and as a deputy attorney general.
Mr. Motiuk was appointed by the Governor of New Jersey as a member of the New Jersey Water Policy and Supply Council. He was also appointed by the New Jersey Supreme Court to its Committee on Character to review all applicants for bar admission.
